hands-offhands-off“Americans for Prosperity is glad to see that the 11th Circuit Court of Appeals recognized the unconstitutionality of the individual mandate in President Obama’s new health care law. Congress has manipulated the Commerce Clause beyond the point of recognition and it is important that the courts step in to reestablish those important limits. The federal government does not have a plenary police power to control the everyday decisions of American citizens. The so-called progressive movement that dominated Washington D.C. and pushed through the new health care law against the strident and vocal opposition of the American people has gone too far in attempting to regulate the inaction of individuals who do not buy health insurance. It’s good to see that the 11th Circuit upheld the Florida decision finding that overreach unlawful.
